Re: Sequels strife

For anyone who happens to check here before seeing it in the UQM forums or reddit, Stardock is now claiming ownership of UQM.

I sincerely and deeply regret every single word I ever wrote or spoke in defense of Brad Wardell. I utterly misjudged the man. He's a criminal and a thief, nothing more.

Re: Sequels strife

Something I've been wondering about. Given that Brad has apparently decided this is a hostile environment, what are the odds of Stardock deciding that "star-control.com" is using their Star Control trademark without permission and benefiting thereby and taking legal action to gain control of the dom...

Re: Sequels strife

The valuable part, for us, has been the Star Control brand. That is why Paul and Fred have continually tried to associate with it. And their legal position has been consistent, regardless of your public interpretations: Their game will be marketed as a direct sequel to Star Control II. If they insi...

Re: Sequels strife

I realize I will always appear the bad guy here. I'm the one posting after all. You're also the one making utterly unsupportable trademark claims way beyond what you ever bought. As unsupportable as trying to cancel what we obviously bought? It's been pointed out to you before, but their DMCA was i...

Re: Sequels strife

No, that's "go for the throat". It's also claims to rights that Stardock has repeatedly said it doesn't have. You can't file a trademark on a word in someone else's IP and then force them to pay you a license fee for their own IP - a court's going to see right through that maneuver. This looks to me...

Re: Sequels strife

I don't know if this got posted already, I didn't notice it if it was, but this is a listing that gets kept up-to-date of all filings in the case: https://www.pacermonitor.com/public/case/23260369/Stardock_Systems,_Inc_v_PAUL_REICHE_III,_et_al So you can just bookmark that and take a look at it ever...

Re: Sequels strife

I believe it is far too early for specific trial dates as yet. For purposes of rough comparison, in the Crytek vs CIG lawsuit - which was also filed in December - the most recent submissions to the court are suggesting a trial date of June 2019. Star Control is far lower profile with a lot less at s...

Re: Sequels strife

Yup, that would seem to be the evidence Stardock claimed they never got. Well, they have it now.

I'm pretty close to convinced at this point. There MIGHT be something further Stardock can pull out to justify their interpretation of the situation but I'm not sure what it might be.

Re: Sequels strife

Stardock keeps pointing to this, but it's only one small set of e-mails out of years of correspondence and on its own it's merely ambiguous. By the account Fred and Paul give in their complaint, though, Wardell repeatedly begged them for a license to their universe and they repeatedly said no, impl...

Re: Sequels strife

I'd never claim anglo-saxon courts are entirely sensible. I'm just saying, this is how they work. I also don't think a court would expect someone to repeatedly object to any and all little details. But the court would be looking for someone to say at least once - preferably fairly early on, once the...
